Terms of Service

1. Who is offering the service

Wardeny is operated by [LEGAL ENTITY NAME], registered in Spain under registration number [REGISTRATION NUMBER]. References to "Wardeny", "we", "us" or "our" in these Terms refer to that entity. Contact: legal@wardeny.com.

2. Acceptance of terms

By accessing or using Wardeny — including the web application, Android app, iOS app and any associated APIs — you confirm that you have read, understood and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you must not use the service.

You must be at least 16 years old to create an account. By registering you confirm that you meet this requirement.

3. NOT a replacement for emergency services

Wardeny is NOT a replacement for official emergency services.

In any life-threatening situation, call 112 (EU), 911 (USA), 999 (UK) or your local emergency number first, before using Wardeny.

Wardeny co-ordinates your community — it does not dispatch trained responders, guarantee message delivery, or monitor for emergencies 24/7. We make no representation that an alert sent through Wardeny will be received, acted upon or responded to within any particular time. Emergency response decisions and accountability remain with you and the official services.

4. Description of the service

Wardeny is a community-coordination Progressive Web App. Its core features include:

  • SOS alerts broadcast to your group or, for guests, all online users.
  • Real-time group location sharing and coordination.
  • In-app text chat within groups.
  • Push notifications for alerts and group events.
  • A personal emergency kit checklist.
  • Offline-capable emergency guides and protocols.

Features marked as beta or experimental may change or be removed at any time without notice.

5. Account registration and security

To access most features you must create an account with a valid email address and a display name. You are responsible for:

  • Keeping your login credentials confidential and not sharing them with anyone.
  • All activity that occurs under your account, whether or not authorised by you.
  • Notifying us immediately at legal@wardeny.com if you suspect unauthorised access to your account.

We reserve the right to disable any account we have reasonable grounds to believe has been compromised or is being used in violation of these Terms.

6. Acceptable use

You agree not to:

  • Trigger SOS alerts knowing there is no genuine emergency (false alarm).
  • Send spam, unsolicited promotional content or bulk messages via chat or push.
  • Impersonate any person or entity, or misrepresent your identity or affiliation.
  • Access, probe or attempt to access accounts, endpoints or data you do not own or have not been explicitly granted access to.
  • Test or probe the security of the service without our prior written authorisation (see SECURITY.md for responsible disclosure).
  • Upload, transmit or distribute malware, viruses or any harmful code.
  • Use the service to harass, threaten, abuse or discriminate against any person, or to facilitate hate speech or illegal activity.
  • Intentionally overload, flood or degrade the service's infrastructure (DDoS, scraping without permission, etc.).
  • Violate any applicable local, national or international law or regulation.

False alarms are treated with particular seriousness. A knowingly false SOS may result in immediate account suspension, notification of relevant authorities where required by law, and civil or criminal liability under your local laws.

7. Content and data you submit

You retain ownership of all content you create — chat messages, group names, kit entries and any other user-generated material. By submitting content you grant us a worldwide, non-exclusive, royalty-free licence to store, process and transmit that content solely as necessary to operate and improve the service for you and your group members.

SOS alert data (including location, if shared) is used exclusively for real-time community coordination. It is not analysed for commercial purposes. Location data is not persisted beyond the active session.

You are solely responsible for the legality, accuracy and appropriateness of content you submit. We do not systematically pre-screen user content but we may remove content that violates these Terms, without notice.

8. Availability and disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AVAILABILITY OR NON-INFRINGEMENT.

We do not guarantee any particular uptime or response time. Planned and unplanned maintenance may make the service temporarily unavailable. Offline-capable features (SOS alerts, kit, guides) will continue to function without network connectivity and will sync when connectivity is restored; however, we cannot guarantee that queued alerts will be delivered if connectivity is not restored before the alert expires.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) €100.

WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF REVENUE, LOSS OF PROFIT, PERSONAL INJURY OR PROPERTY DAMAGE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Nothing in this section limits liability that cannot lawfully be excluded or restricted under applicable law in your jurisdiction, including EU consumer protection law and Spanish consumer law.

10. Intellectual property

The Wardeny name, logo, software and all proprietary content are owned by us or our licensors and are protected by applicable intellectual property law. See the LICENSE file in our public repository for open-source licence terms. Nothing in these Terms grants you any right to use our trademarks or trade names.

11. Termination

We may suspend or permanently terminate your access at any time if we have reasonable grounds to believe you have breached these Terms, without prejudice to any other remedies available to us. We will make reasonable efforts to notify you where lawful and practical.

You may stop using the service at any time. To delete your account and all associated data, use the “Delete account” control in your profile. Sections 7, 9, 10 and 12 survive termination.

12. Governing law and disputes

These Terms are governed by and construed in accordance with the laws of Spain. Any dispute arising out of or relating to these Terms or the service shall be subject to the exclusive jurisdiction of the courts of Barcelona, Spain — without prejudice to any non-waivable consumer rights you hold under the law of your country of habitual residence.

EU residents may also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr.

13. Changes to these terms

We will notify you of material changes to these Terms at least 30 days before they take effect via an in-app banner. Continued use of the service after the effective date constitutes acceptance of the revised Terms. Non-material changes (grammar corrections, clarifications that do not alter your rights) may be made at any time without prior notice. The current version is always available at /legal/terms.
